TERMS OF SERVICE — THE MAKINGS BY SWANN

1. Ownership & Intellectual Property

All products, designs, formulas, artwork, photographs, labels, packaging, scents, and branding associated with The Makings by Swann are the exclusive property of the owner.
Unauthorized duplication, reproduction, or alteration of any product or design is strictly prohibited.

2. Resale Restrictions

Customers may NOT resell any product purchased from The Makings by Swann without prior written approval and a signed reseller agreement from the owner.

Reselling includes but is not limited to:

  • Online marketplaces (Amazon, Etsy, eBay, TikTok Shop, Shopify, etc.)

  • Physical stores, boutiques, pop-ups, or vendor tables

  • Bulk or wholesale distribution

Any unauthorized resale, bulk purchasing, or redistribution may result in:

  • Order cancellation

  • Legal action

  • Permanent ban from purchasing

All resale rights are granted at the sole discretion of the owner.

3. Body Care & Skincare Products — Final Sale

Due to the personal, hygienic, and handcrafted nature of our body care products, all skincare and body products are FINAL SALE.
This includes (but is not limited to):

  • Body butters

  • Body oils

  • Lotions

  • Scrubs

  • Soaps

  • Bath products

  • Specialty seasonal items

We do not accept returns, exchanges, or refunds for any body or skincare products.

4. Ingredient Transparency & Allergy Responsibility

All ingredients are listed publicly on product labels and in each product description.

By purchasing, the customer acknowledges and agrees that:

  • They are responsible for reading all ingredient lists before use

  • They must check for any personal allergies or sensitivities

  • They assume full responsibility for how the product interacts with their skin

  • The Makings by Swann is not liable for allergic reactions, skin sensitivities, or misuse of products

If a customer is unsure about allergies, they can do a small patch test or consult with a doctor prior to using.

5. Liability Disclaimer

By purchasing from The Makings by Swann, the customer agrees that:

  • They use all products at their own risk

  • The owner and business are not responsible for:

    • Allergic reactions

    • Improper storage or misuse of the product

    • Skin irritation caused by user-specific sensitivities

    • Any adverse reaction arising from failure to read ingredients

The Makings by Swann disclaims all liability except where prohibited by law.

6. Product Use & Safety

Customers agree to:

  • Use products only as directed

  • Store products properly (in cool, dry locations, out of direct heat)

  • Keep products away from children unless otherwise stated

  • Avoid contact with eyes and discontinue use if irritation occurs

7. Order Processing & Cancellations

Because products are handmade and often made-to-order:

  • Orders cannot be canceled once processing begins

  • Processing and shipping times may vary due to order volume and seasonal demand

8. Changes to Terms

The Makings by Swann reserves the right to update or change these Terms of Service at any time. Continued use of the website or purchase of products constitutes acceptance of updated terms.
